As of April 2026, Ordinance 25-2 (effective September 30, 2025) allows an Oahu single-family lot to host both an ADU and an ohana dwelling for up to three units total, and statewide Act 39 (HRS 46-4.8, 2024) requires Honolulu to permit at least two ADUs on residential lots by December 31, 2026, with the owner-occupancy requirement waived for the baseline and a 1,250 sq ft cap.
Kailua is largely R-5, R-7.5, and R-10, with additional special management area (SMA) and flood-zone overlays near the coast that add permitting steps. Honolulu has not adopted IRC Appendix Q, so foundation tiny homes follow the full 2018 IRC as a dwelling or ADU. ADU maximum size remains 400 sq ft on sub-5,000 sq ft lots and 800 sq ft on larger ones, with one off-street parking space required unless near Skyline — which does not yet serve Kailua. Short-term rental of an ADU is prohibited; six-month minimum lease.
